Midtown Martial Arts (MMA) Membership Agreement
Assumption of Risk and Physical Condition
The member or parent represents that the member is in good physical condition and able to safely participate in the programs and services provided by Midtown Martial Arts. Martial arts training involves inherent risks, including the risk of physical injury. The member or parent voluntarily assumes all risks associated with participation and expressly agrees that Midtown Martial Arts, its owners, employees, and agents shall not be liable for any damages arising from personal injury sustained by the member or the member’s guests in, on, or about the premises as a result of participation in martial arts classes, related activities, or use of equipment.
Responsibility for Injury and Property
The member or parent assumes full responsibility for any injuries or damages that may occur to the member or the member’s guests while participating in Midtown Martial Arts activities. The member or parent further agrees that Midtown Martial Arts shall not be liable for the loss, theft, or damage of personal property brought onto the premises.
Release and Waiver of Liability
The member or parent fully and forever releases, waives, and discharges Midtown Martial Arts and its owners, employees, and agents from any and all claims, demands, rights, liabilities, or causes of action, whether known or unknown, anticipated or unanticipated, present or future, arising out of or related to the member’s or the member’s guests’ participation in Midtown Martial Arts classes, activities, programs, facilities, or use of equipment.
Indemnification
The member or parent agrees to indemnify, defend, and hold harmless Midtown Martial Arts and its owners, employees, and agents from any and all claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising from the member’s or the member’s guests’ participation in Midtown Martial Arts activities or violation of this agreement.
Supervision, Drop Off, and Pick Up Policy
Midtown Martial Arts is not responsible for the supervision, care, or safety of minor children before class begins or after class ends. Parents or legal guardians who choose to drop off and pick up their child assume full responsibility for their child during all times outside of scheduled class instruction.
Midtown Martial Arts, its owners, employees, and agents shall not be liable for any injury, loss, or incident occurring before class start time, after class dismissal, or while a child is waiting to be picked up. It is the responsibility of the parent or guardian to ensure timely drop off and pick up of all minor students.
Parents or guardians who remain on site during class retain full responsibility for supervising their child outside of active instruction.
Class Availability and Schedule Changes
Midtown Martial Arts agrees to make classes available to members. Class schedules, instructors, and program formats may change at any time. Midtown Martial Arts may close temporarily for holidays, instructor training, special events, or scheduled breaks.
No Guarantees or Warranties
Midtown Martial Arts makes no representations or guarantees regarding results, rank advancement, belt promotion, physical outcomes, or skill progression. No warranties, express or implied, are made other than those expressly stated in this agreement.
Membership Inclusions and Additional Fees
Membership fees and monthly dues include martial arts instruction only. Optional extracurricular activities including belt testing, tournaments, seminars, camps, demonstrations, or special events may require additional fees. Uniforms, safety equipment, weapons, and other required materials are not included and must be purchased separately. All required equipment must be approved by Midtown Martial Arts.
Right to Refuse or Terminate Membership
Midtown Martial Arts reserves the right to refuse enrollment or terminate a membership agreement at its sole discretion for conduct or behavior deemed unsafe, disruptive, or inconsistent with school policies.
Photo and Media Release
The member or parent grants Midtown Martial Arts the irrevocable right to photograph, record, and use the member’s likeness, image, or voice for promotional, marketing, advertising, or website purposes without compensation. All media is the property of Midtown Martial Arts.
Cancellation and Membership Pause Policy
Memberships may be cancelled by providing written notice to Midtown Martial Arts at least 30 days in advance. Upon submission of written notice, the member will continue to be billed for the full 30 day notice period, regardless of class attendance or participation.
Memberships may be paused for a maximum of three consecutive months. A pause request must be submitted in writing and approved by Midtown Martial Arts. To initiate a pause, the member must first complete the required 30 day notice period and payment. This satisfies the notice requirement in the event the member elects not to return following the pause.
No refunds, credits, or prorated charges will be issued for unused classes, missed classes, or time not attended.
Automatic Renewal
The member understands and agrees that this membership automatically renews on a month to month basis in the same billing method and amount unless Midtown Martial Arts receives written cancellation notice at least 30 days prior to the desired termination date.

Midtown Martial Arts respects your privacy and is committed to protecting your personal information.

- Mailing address
- Email address
- Phone number
- Emergency contact information
- Payment and billing information

How Information Is Used
Collected information is used solely for legitimate business purposes, including:
- Processing memberships and payments
- Communicating regarding classes, schedule updates, events, and program information
- Maintaining attendance and rank records
- Providing customer support
- Ensuring student safety and emergency contact access
Text Messaging and Electronic Communications
If a member or parent opts into SMS communications, Midtown Martial Arts may send informational messages related to:
- Class reminders
- Schedule updates
- Testing eligibility
- School announcements
- Account notifications
Data Protection and Third Party Sharing
Midtown Martial Arts does not sell, rent, trade, or share personal information with third parties for marketing purposes.
Information may be stored or processed using secure third party software providers for billing, scheduling, and communication purposes. These providers are contractually obligated to maintain data confidentiality and security.
Personal information will only be disclosed if required by law or necessary to protect the safety and rights of Midtown Martial Arts or its members.

Message Frequency
Message frequency will vary depending on class enrollment, school updates, and account activity. Members may receive recurring messages.
Message and Data Rates
Message and data rates may apply based on your mobile carrier plan. Midtown Martial Arts is not responsible for any charges incurred from your mobile carrier.
Opt Out Instructions
You may opt out of receiving text messages at any time by replying STOP to any message. After sending STOP, you will receive confirmation and will no longer receive SMS messages unless you re enroll.

Participation in the SMS program is voluntary and not a condition of membership.
Severability
If any provision of this agreement is held to be invalid or unenforceable, such provision shall be severed and the remainder of the agreement shall remain in full force and effect.
Governing Law and Venue
This agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma. Venue for any dispute arising from this agreement shall lie exclusively in the appropriate court located within the State of Oklahoma.
Entire Agreement
This agreement constitutes the entire understanding between the parties and supersedes all prior agreements or representations, whether written or oral. No amendment or modification shall be valid unless made in writing and signed by Midtown Martial Arts.
Acknowledgment and Signature
By signing, I acknowledge that I have read, understand, and agree to all terms of this agreement and affirm that I am legally authorized to sign on behalf of myself or my child.
